Terms of Service and Conditions
The terms, “us”, “we” and “our” refer to See Me Thrive Adapted Toys.
This website is operated by See Me Thrive Adapted Toys. These Terms set forth the terms and conditions under which you may use our website and services offered by us. This website offers visitors the opportunity to purchase adapted toys and switches to be used by individuals with physical and/or intellectual disabilities. By accessing or using the website or our services, you approve that you have read, understood, and agree to be bound by these Terms.
In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
When buying an item, you agree that: (a) you are responsible for reading the full item listing before making a commitment to buy it; (b) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
We do not sell to companies that have the intent to resell our products. Our service is a courtesy to individuals with physical and/or intellectual disabilities and/or to agencies that have been vetted by us to purchase said products.
The prices we charge for using our services and our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.
Products offered on our page are items that we have custom adapted to be activated with an attached switch, which is not included with toy purchase, but can be purchased separately. If at any time a purchase is made and it is discovered to be out of stock and we are unable to get the item requested in a timely manner, or unable to make a suitable substitution agreed upon by you, we will refund to you any payment you have made promptly.
Products can be returned only for non-working issues. Products have a 30-day-warranty, unless otherwise stated in the product description. You must ask for a return code and a mailing label will be emailed to you to return the product. When we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product.
If the product is unavailable, we will offer a suitable substitution. We will pay for shipment of repaired or replaced warrantied products to customer.
You agree to receive from time to time promotional messages from us by mail, email or any other contact form you may provide us with. If you do not wish to receive such notices, notify us at any time by email at seemethrive@aol.com.
These Terms, the rights and remedies provided hereunder, and any all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United States of America in the state of Mississippi without respect to its conflict of laws.
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all intellectual Property Rights related thereto, are the exclusive property of See Me Thrive Adapted Toys. Nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use at any time.
You agree to indemnify and hold See Me Thrive Adapted Toys harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services or products offered on the website.
To the maximum extent permitted by applicable law, in no event shall See Me Thrive Adapted Toys be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, See Me Thrive Adapted Toys assumes no liability or responsibility for any (a) errors, mistakes, or inaccuracies of content, (b) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our services or products, and (c) any unauthorized access to or use of our secure servers and / or any and all personal information stored therein.
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. Your continued use of our website at www.seemethrive.org constitutes your acceptance of these Terms herein. If you do not agree to any of these terms or any future version of the Terms, do not use or access or continue to access the website, service and/or products.
TOY POLICIES: See Me Thrive is a nonprofit corporation dedicated to providing modified toys to disabled individuals. Liability: The person purchasing or receiving the modified toy through See Me Thrive assumes all liability for the modified toy. If the recipient is acquiring the modified toy for a family member, friend or client, the recipient assumes responsibility for informing the intended user of the risk and conditions of the toy's use and for providing a copy of the receipt and a copy of these policies. LIABILITY RELEASE FOR THE RECEIPT OF MODIFIED TOY FROM See Me Thrive: This release is by and between the recipient (and the parent, guardian, or representative) and See Me Thrive. See Me Thrive is a nonprofit corporation dedicated to providing modified toys to disabled individuals. The recipient and their representative agree(s) to the following terms and release of liability. 1. In consideration of the modified toy acquired by purchase through See Me Thrive, the recipient - on behalf of himself or herself, the purchaser, and/or behalf of his or her caregivers, family members, heirs, successors, executors and administrators (collectively, the "recipient") - agrees that he/she will NOT make against, sue, attack the property of, libel, slander, or prosecute See Me Thrive, See Me Thrive Adapted Toys, or See Me Thrive Adapted Toys' directors, officers, employees, agents, volunteers, (collectively, "See Me Thrive Adapted Toys" for any injury or damage resulting from negligence or other acts, however caused, by See Me Thrive Adapted Toys and its affiliates, relating in any way to the modified toys or supplies. 2. The recipient (and the caregiver or representative) is responsible for ensuring that the purchased item is appropriate for the needs for whom it is acquired. See Me Thrive does not provide assessments, and any inadvertent suggestions made by See Me Thrive are not to be considered professional advice. Involvement of your qualified therapists and other health care professionals is recommended in selecting, receiving, using, and maintaining your modified toys or supplies. 3. The recipient will not use modified toys or supplies suspected to be functioning improperly, and return them to See Me Thrive promptly. 4. Modified toys and supplies are available for purchase for disabled individuals, therapists (for use in therapy sessions), special needs' teachers (for use in special needs classrooms or by special needs' individuals). Modified toys and supplies acquired at See Me Thrive are not to be purchased to be resold. 5. We are not qualified medical professionals. Modified toys and supplies must be accepted on an "as-is" and "at your own risk" basis. 6. The recipient (and parent, guardian, caregiver, or representatives) acknowledges that he/she has voluntarily purchased the modified toy and supplies from See Me Thrive. 7. The recipient is aware that any prescriptions, maintenance costs, modifications, safety requirement, or other conditions necessary for the use of said modified toys and supplies are the sole and exclusive responsibility of the recipient. Use of said modified toys and/or supplies is at the sole discretionary risk of the recipient, and misuse, or use without supervision could result in harm. See Me Thrive or See Me Thrive Adapted Toys is not liable for any injury, damage, or other adverse event. 8. See Me Thrive reserves the right to refuse service to or sell to anyone becuase the potential recipient is suspected of being dishonest, because See Me Thrive Adapted Toys' directors believe the recipient will not properly/safely use the modified toys or supplies, believes that the recipient is acquiring for resale, or for any other reason that See Me Thrive feels placing the modified toys or supplies will be a liability to the organization. Using modified toys has inherent risk. The recipient (and/or caregiver or representative) agrees that by purchasing modified toys and supplies at See Me Thrive that they have read carefully the Liability Release and the Policies and Terms of Use, and fully understands their contents. The recipient is aware that this is the release of liability between the recipient and See Me Thrive and See Me Thrive Adapted Toys and its affiliates. The recipient will receive a copy of this release upon purchase of modified toys and supplies at See Me Thrive and will keep for their records and ensure that the user of the modified toys or supplies fully understands and agrees to its contents.
